Motion For Summary Judgment Discussion - by TowerRat
ladygarner:
I found this in the Archives under the old AOC files. It is an excellent discussion on MSJ whether you are the Plaintiff or Defendant. TowerRat wrote a brilliant post and even includes a dash of humor.
It taught me that I could have filed a Request for Admissions with my Complaint. Very slick, too bad I found his post after I filed. :-\
It proved very beneficial to me, I hope it will for others.

I found the work of an attorney in NJ who upon receiving the summons and complaint, filed his answer to the complaint and filed for summary judgement pre-discovery.

In Michigan, we can send Discovery with the Complaint. However, it extends the amount of time that a defendant has to answer the discovery.
