Very interesting!

I am in JAMS with Discov at the moment.

Cap One should be on the chopping block for this also.

They  blatantly lie about their  new "Cardmember Agreements" as most readers
of this forum  know.

I think this is just another tactic to have the case dropped, like using arbitration - rather than a serious class action.

I researched about 3-4 of these cases and they all ended in a settlement. 

Not a bad tactic if you don't have an arbitration clause in your contract.

One of the CA's in one of the cases even tried using arbitration himself! LOL!

Judge denied it!!!
