If court case was stayed, but now closed
« on: May 05, 2011 07:09:04 PM »
If court case was stayed, but now closed, how do I or them confirm a award if one is granted in JAMS?

Recap:

I had MTC stayed with MY counterclaims attached, then attorney ask for a new trial to remove MTC

stay, but it was overruled!

I made the court order, had attorney sign and the Judge, then filed with the court house.

This morning I check out the website and to my surprise the case is now CLOSED!

I thought it would be just STAYED, but it is totally closed even though I had counter claims against

them.

Is either party able to reopen the case after JAMS to confirm a award?

Fighting until I hear the fat lady sing!
3 cases against me... all finished favorably.

Arbitration record: 0 wins,  1 loss, turned to a WIN!
Court Record:  3 WINS!

CASES:
1.) received dismissal after election of ARB, then at 3yrs., 1099;
2.) above Arbitration judgment was dismissed with prejudice, after a fight in Court. Later OC totally deleted item from credit report.
3.) Settled... NDA

Reopen old case ... or file new case ... you probably have your pick.

By domesticating the judgement in your local jurisdiction.

See your local Rules of Civil Procedure.

Thats what I thought, but I was not sure.

Since they filed against me could I

reopen the case since my counter claims are still intact?

Or do they have to reopen it?

Has anyone ever used a "Judgment Recovery Service" to collect a judgment for them, being that sometimes it might be difficult to do for a pro se?

I have not, but I do have a 14K judgment to collect.

I may be looking into the issue.
My free speech is not legal advice.  If you need legal advice, you need to talk to a lawyer.

Litigation Defense record
Arbitration record:   9 wins * 0 loses
Court Record:         2 wins * 2 judgments (1 of the 2 judgments has been vacated, other judgment upheld on appeal, marked "satisfied", because I wrote a check.)

The one bank that beat me in court, I now have a $2200 limit credit card from them again.
Redemption is always possible.
