Hi, my mom got a call from a company calling itself NorthEastern. from 7167701201, from a Lisa Decker saying she was in the litigation and garnishment department.. She scared her to death claiming she didn't want me to be "blind sided". The debt is mine, last action was May 29, 2013. I live in PA. I have a couple of questions, is a collection agency even allowed to say I have a debt? I have not received anything from this company, is it a law firm? Shouldn't I have received some sort of legal filings before any type of garnishment could take place.

 I will be honest it has me a bit freaked out as well. The debt is real. Are they just a vulture debt collector trying to capitalize on tax return time?

They are FRAUDS.  DO NOT pay them.  Tell your friends and family you have been targeted by scammers and not to panic and pay them. The script she is using is verbatim what the scammers use.  Unless they sue you they cannot garnish anything.  Tell them to sue you.  If by some miracle they actually follow through and sue (actually filing in court and serving you) then come back here and we will assist you in defeating it.

I suspected as much, but it still concerned me. I tend to freak out when someone mentions the legal system involving me...but I guess that is what they prey upon. Thank you very much for the reply.

Biggest red flag it is a scam: they call friends and family first followed by the very fact that process servers and "litigation specialists" do not call you and tell you they are coming with papers for you within a 2 hour time frame and you have to have 2 forms of ID to sign for them.  Or that you are going to be arrested.  If they are actually arresting you or serving papers they show without notice because seriously, who would stay home and wait?

Just to be on the safe side, check your local court docket to see if anything has been filed against you.

Quick questions :  Was it a joing account and/or was your mother a guarantor of the alleged debt?

It was not a joint account, nor was her name in any way affiliated with the account.

Meaning, no she wasn't a guarantor. Should I be looking for civil docket numbers? I'm not sure how to check for a docket. Closest I have found is

716 is Buffalo NY. Virtually all of these scams originate there, for some reason. Report it to the NY AG Eric Schneiderman, I believe is his name. Don't pay them anything.

Various NY AGs have put a number of these scammers out of business, esp. those in Buffalo. (Also Mitchel N. Kay in NYC)

However, many of them simply open up shop with a new name when the heat is on. 

This is clearly illegal debt collection, and possibly criminal behavior on their part.  Be sure to report it.
