Case Dismissed, over $13,000 wiped out!
« on: February 17, 2013 11:37:14 AM »
My year-long battle with C1 was finally dismissed.

Though without prejudice, the SOL has run making the possibility of refiling impossible.

Can you add me to the ticker please?

That's no small drop in the bucket. Good job!

Congrats.  I would now sue everybody for any and all FDCPA violations that I can think of.

Aside from filing a suit that they couldn't back up without the witness they promised would be there if I sent a second subpoena [that I would allow to be subserved] the only iffy thing they did was do a hard pull on my credit six months after filing suit.

As this is a common debate everywhere I look, it wasn't a consideration of mine.

*For the sake of clarity, the first server didn't serve the subpoena because the "authorized agent for service of process" said they didn't even know who she was!

This was for a CCP 98 Declarant, and as the code clearly states they must be available for service within the twenty days prior to trial and have a current address within 150 miles of the court, I understood why the server didn't leave it.

A second subpoena was subserved because it was ordered by the judge. Their attorney stated during the first trial date that he would make arrangements for her to be present. So, the trial was continued against my objections.*

I can't see any violations but if anybody else does, by all means, please advise!
