If it is not too late, I'd send some out.

If you had sent request for admissions, you would file a Motion to Deem Admitted. That locks their non-response into the record.

Your civil rules may also have something along those lines - in some states, if you fail to answer discovery in a certain time, it's possible to file a motion to prevent them from sending you discovery after the deadline.

Follow up the status of your motion to compel arbitration. If you can, go to the clerk and try and get it put on the calendar for a hearing.

I lost a MSJ to Chase and am now appealing that. But I just now saw this new information. Can I file a Motion to Vacate Judgment in the trial court based on this new information? OR do I have to wait for the appeals process to go through?

I believe I cannot introduce this new information into the appeals process...they are only allowed to consider the existing facts in the suit.

However, this is very germane to my case...

Anyone here up on New Jersey law?
